Indirect Tax Alert - GST Council Recommendations Take Effect: Analysis of Key Notifications, Circulars and Instructions

In a significant move towards trade facilitation, reduction of compliance burden and enhancement of ‘ease of doing business’, the Central Board of Indirect Taxes and Customs (CBIC) has issued a series of notifications, circulars and instructions to operationalise the recommendations of the 57th GST Council meeting and address several long-pending interpretational and procedural issues under the GST regime.

The measures cover a broad spectrum of subjects, including clarifications on GST rates on certain goods and services, expansion of tax exemptions, introduction of reverse charge liability on specified transactions, reforms in registration procedures, substantial overhaul of refund provisions, strengthening of the Input Service Distributor framework and expansion of the e-invoicing ecosystem.

CBIC has also issued detailed clarifications on the demand and adjudication proceedings, appeal-related pre-deposit requirements, export realisation conditions, classification disputes, sector-specific issues, and the retrospective implications of the omission of Rule 96(10) of Central Goods and Services Tax Rules, 2017.

We at BDO India have summarised the key amendments, clarifications and administrative directions.
